1. Scope of application and use

1.1

These Terms of Use apply to the website https://wheretowatchtv.com (the Site or WhereToWatchTV) operated by Creatr Studios Inc., 5 Mariner Terrace, Toronto, Ontario, Canada M5V 3V6 (we, us, or the Company).

1.2

The Site is intended for personal, non-commercial use. You should be of the age of majority in your place of residence. If you are a minor, you may use the Site only with the permission of a parent or legal guardian, and that person must have acknowledged these Terms.

1.3

WhereToWatchTV is provided as is and as available, without any warranty, express or implied. We disclaim implied warranties of merchantability, fitness for a particular purpose, availability, security, title, and non-infringement, to the fullest extent permitted by law.

We do not warrant that the Site is free of inaccuracies, faults, or interruptions, or that listings, prices, schedules, or research pages are complete, current, or reliable. Use of the Site is at your own risk. You are responsible for damage to your system or loss of data arising from that use, except where Canadian consumer law does not allow that allocation of risk.

We may adapt and update these Terms. The “Last updated” date will change when we do.

2. Usage options

2.1

You can use WhereToWatchTV without creating an account. There is no paid WhereToWatchTV subscription. On the Site you can search movies, series, seasons, and episodes; see where they appear to be available to stream, rent, buy, or watch free in the United States, Canada, the United Kingdom, and Australia; browse a national TV guide for the US and Canada; and read research such as titles that left Netflix in a country this week.

2.2

We are not a streaming service. We do not host, transmit, or license the films or episodes listed. We do not sell subscriptions, rentals, or tickets. A watch link opens a third-party service that has its own terms and prices.

3. Affiliate links

Some watch, rent, buy, or visit-service links are affiliate links. If you subscribe, rent, or purchase after following one, Creatr Studios Inc. may receive a commission at no extra cost to you. Partners include Amazon Associates and Impact (including certain Fubo links). We are not the merchant. The transaction is solely between you and that service.

4. Liability

4.1

To the fullest extent permitted by law, we exclude liability for indirect, incidental, consequential, or special damages, lost profits, and other pecuniary loss arising from use of the Site, whether in contract, warranty, tort (including negligence), or otherwise, even if we were told such loss was possible.

4.2

This limitation does not apply to fraud, fraudulent misrepresentation, or our gross negligence or wilful misconduct, or to death or personal injury caused by our negligence where that cannot be limited. If you are a consumer in Ontario, the rest of Canada, the UK, the EEA, or Australia, rights you have under mandatory consumer-protection law are not affected.

4.3

The Site contains links to third-party websites. We have no control over their content and give no warranty for it. The operator of the linked site is responsible for it. If we become aware that a link is unlawful, we will remove it.

4.4

Except where the law requires otherwise, our total liability for claims relating to the Site will not exceed one hundred Canadian dollars (CAD $100).

5. Service content, software and copyright

5.1

The Site, including original text, layout, software, and the WhereToWatchTV name and logo, is protected by copyright, trademark, and other laws and is owned by Creatr Studios Inc. or its licensors. Movie and series titles, artwork, and trademarks remain the property of their owners and are shown for identification so you can find where to watch those works. We are not affiliated with, endorsed by, or sponsored by Netflix, Amazon, Apple, Disney, Max, Hulu, Google, IMDb, or other named services unless we say so.

5.2

You may not copy, scrape, reverse engineer, frame, rent, sell, or create derivative works from the Site for a public or commercial purpose, or use data mining, robots, or similar extraction in a way that overloads or circumvents the Site. If we block access (including by IP), you agree not to bypass that block. Any right not expressly granted is reserved. Personal, non-commercial use of the guide, including linking to a page, is allowed.

5.3

Catalogue, poster, rating, availability, and TV-listing data come from third-party sources. We respect third-party copyright. If you believe material on the Site infringes, email [email protected]. We will remove unlawful content when we become aware of it.

5.4

Listings, prices, schedules, and research pages can change or disappear without notice. We do not guarantee that a title is available or that a broadcast will air as shown. Always confirm on the service itself before you pay.

6. Data privacy

We process personal data as described in our Privacy Policy. That policy is part of how we operate the Site together with these Terms.

7. Miscellaneous

7.1

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario, without regard to conflict-of-law rules. If you are a consumer in another province or in the UK, EEA, or Australia, mandatory local consumer protections still apply and you may bring eligible claims in your home courts. Otherwise, the courts of Ontario have exclusive jurisdiction, and you attorn to those courts.

7.2

Creatr Studios Inc. does not participate in an alternative consumer-dispute settlement procedure before a statutory dispute-resolution entity and is not obliged to do so, except where the law requires it.

7.3

If a provision is invalid or unenforceable, the rest of these Terms remain in effect. These Terms and the Privacy Policy are the entire agreement for your use of the Site. Failure to enforce a term is not a waiver. You may not assign these Terms; we may assign them if the Site is transferred.
